Terms of Service

The agreement between you and Bright Arc Software. The important parts: this is not a certified navigation system, and the assist feature is not a rescue service.

The agreement

These terms are between you and Bright Arc Software. By creating an account or using Navi Wake you accept them. If you do not accept them, please do not use the service.

You must be at least 13 years old, and old enough to operate a vessel lawfully where you are boating if you intend to use Navi Wake while under way.

Not a substitute for official charts

Navi Wake is an aid to planning and situational awareness. It is not a certified navigation system and must not be your only means of navigation. Always carry official charts and keep a proper lookout.

Depth data, hazard reports, water levels, weather and routing are estimates drawn from public datasets and from other boaters. Lake beds shift, water levels change daily, debris moves, and reports can be wrong or out of date. A route drawn by Navi Wake is a suggestion, not a guarantee of safe water.

You are the operator. Every decision on the water — speed, course, clearance, whether to go out at all — is yours, and you remain responsible for the safety of your vessel and everyone aboard. Please read the safety notice.

Your account

Keep your password to yourself and tell us promptly if you think someone else is using your account. Give us accurate information when you sign up.

You can close your account at any time from your account page. We may suspend or close an account that breaks these terms, particularly the content rules below.

Content you post

Navi Wake lets you publish hazard pins, reviews, assist requests and profile details that other boaters can see. You keep ownership of what you write. You grant us a licence to host, display and distribute it within the service so it can reach the boaters it is meant for.

You agree not to post:

  • false hazard reports, or anything intended to mislead another boater about the safety of the water;
  • harassing, threatening, hateful, obscene or defamatory material;
  • someone else's personal information;
  • spam, advertising, or content you have no right to post;
  • anything unlawful.

A deliberately false hazard report can put people in danger. We treat it as the most serious breach of these terms and will remove the content and close the account.

Reporting content. If you see something that breaks these rules, email support@naviwake.com with a description and, if you can, the lake and location. We aim to review reports within 24 hours and will remove content that breaks these rules and act against the account behind it. We can remove any content at our discretion, and we are not obliged to keep anything published.

Assistance requests are not a rescue service

In an emergency call the Coast Guard, marine patrol, or 911. Do not rely on Navi Wake.

The assist feature simply shows your request to other boaters who happen to have that lake open. Nobody is on duty, nobody is obliged to come, and there is no guarantee anyone will see it. It is a courtesy between boaters, not an emergency service, and neither we nor any responding boater owes you a rescue.

Float plans work the same way: sharing one does not alert any authority. It only shows your plan to the person you sent the link to.

Subscriptions and payment

Some features may require a paid pass. Where you buy a subscription on our website, payment is processed by Stripe and it renews automatically for the period you chose until you cancel. You can cancel at any time from your account page; access continues to the end of the period you have already paid for.

Where you buy a subscription inside an app distributed through Apple's App Store, that purchase is handled by Apple. It is billed to your Apple Account, renews automatically unless you turn renewal off at least 24 hours before the period ends, and must be cancelled through your Apple Account settings — deleting the app or your Navi Wake account does not cancel it. Refunds for those purchases are handled by Apple under its own policy.

We may change prices. If we do, we will tell you before the change affects a renewal, and you can cancel instead.

Disclaimer and limits

The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that any chart, depth, hazard, weather or routing data is accurate or current.

To the fullest extent permitted by law, Bright Arc Software is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, vessel, property, injury or death, arising from your use of the service. Our total liability for any claim relating to the service will not exceed the greater of the amount you paid us in the twelve months before the claim, or fifty US dollars.

Some jurisdictions do not allow these exclusions, so parts of this section may not apply to you. Nothing here limits liability that cannot lawfully be limited.

Changes, law and contact

We may update these terms. If a change is material we will say so in the app or by email; continuing to use Navi Wake after that means you accept the new terms.

These terms are governed by the laws of the State of North Carolina, United States, without regard to conflict-of-law rules.
